Terms and conditions for goods sold by The Good Guys Discount Warehouses (Australia) Pty Ltd ABN 48 004 880 657 from commercial.thegoodguys.com.au.
These Terms and Conditions constitute a legally binding contract between the customer, (“you”) and The Good Guys Discount Warehouses (Australia) Pty Ltd (ACN 004 880 657) (“The Good Guys”) and apply to the ordering, purchase, fulfilment and delivery of goods (“Goods”) from commercial.thegoodguys.com.au. By placing an order for Goods from The Good Guys you agree to these Terms and Conditions.
Please read the following Terms and Conditions carefully before placing your order. The Terms and Conditions contain important information about the ordering, processing, fulfilment and delivery of Goods.
Different terms and conditions will apply to you depending upon whether you are:
- a sole trader, partnership, company, trust, institution (including a school) or a government body paying for Goods under an existing credit account with The Good Guys;
- a sole trader, partnership, company, trust, institution (including a school) or a government body paying for Goods other than under an existing credit account; or
- an individual acquiring the Goods wholly or predominantly for personal, domestic or household use or consumption.
Please ensure read the information below carefully in order to check which terms and conditions apply to you.
PARTNERSHIPS, COMPANIES, TRUSTS, INSTITUTIONS (INCLUDING SCHOOLS) OR GOVERNMENT BODIES PAYING FOR GOODS UNDER AN EXISTING CREDIT ACCOUNT
If you are a The Good Guys Commercial Credit Account holder, both the terms of that The Good Guys Commercial Credit Account and Sections 1 through 20, excluding section 8.8 , of these Terms and Conditions will apply to any order from commercial.thegoodguys.com.au which you choose to pay for using your Credit Account. To the extent of any inconsistency between the credit terms and these Terms and Conditions, these Terms and Conditions shall prevail.
SOLE TRADERS, PARTNERSHIPS, COMPANIES, TRUSTS, INSTITUTIONS (INCLUDING SCHOOLS) OR GOVERNMENT BODIES PAYING FOR GOODS OTHER THAN UNDER AN EXISTING CREDIT ACCOUNT
If you are a sole trader, partnership, company, trust, institution (including a school) or a government body paying for Goods other than under an existing credit account, all the terms and conditions numbered 1 to 20 below will apply to any Order.
INDIVIDUALS ACQUIRING THE GOODS WHOLLY OR PREDOMINANTLY FOR PERSONAL, DOMESTIC OR HOUSEHOLD USE OR CONSUMPTION
If you are an individual acquiring the Goods wholly or predominantly for personal, domestic or household use or consumption all the terms and conditions numbered 21 to 39 below will apply to any Order.
TERMS AND CONDITIONS
1. DEFINITIONS
In Sections 2 to 20 of these Terms and Conditions:
“Account” means an account created by you on the The Good Guys Commercial Website or portal as applicable (this is not the same as any The Good Guys Commercial credit account that you may have);
“Additional Delivery Charge” has the meaning given in Section 3.1;
“Big and Bulky Delivery” means a Delivery Option where the Goods to be delivered are “big and bulky” goods;
“Business” has the meaning given in Section 2;
“Consumer” has the meaning given to it in the Australian Consumer Law;
“Consumer Goods” means goods of a kind ordinarily acquired for personal, household or domestic use or consumption, as that expression is used in the Australian Consumer Law;
“Consumer Guarantee” has the meaning given to it in sections 51 to 64A of the Australian Consumer Law;
“Delivery Charge” has the meaning given in Section 5.3;
“Delivery Options” means the delivery options available for an Order which are listed on the Website, as updated from time to time. The delivery options available for an Order will vary depending on factors such as the nature of the Goods you are purchasing and your delivery address. Delivery options may include: Standard Delivery; Express Delivery; Australia Post eParcel; Courier Delivery; Unpack & Connect (selected bulky goods); and Premium Delivery (selected bulky goods). Delivery Charges and estimated delivery times may vary for each Delivery Option;
“Distribution Centre” means a The Good Guys distribution centre open to the public for pre-arranged pre-paid order collections;
“Order” means an order for Goods, placed on the Website;
“Password” means the password needed to access your Account, or any offer, opportunity or feature associated with your Account;
“Premises” means the premises specified by you for delivery;
“Restricted Goods” means Goods which are only intended to be viewed, played, listened to or otherwise utilised by a person of at least a certain age;
“Title Guarantee” means a guarantee pursuant to any of section 51, 52 or 53 of the Australian Consumer Law;
“Selected Delivery Option” has the meaning given in Section 11.1; and
“Website” means commercial.thegoodguys.com.au.
2. THE CUSTOMER
By placing an Order on the Website you acknowledge that you are a sole trader, partnership, company, trust, institution (including a school) or a government body (a “Business”) and are not an individual acquiring the Goods wholly or predominantly for personal, domestic or household use or consumption.
3. YOUR LEGAL RIGHTS UNDER THE CONSUMER GUARANTEES PROVIDED BY THE AUSTRALIAN CONSUMER LAW
3.1 Your purchase of Goods may be subject to certain laws including, without limitation, the Australian Consumer Law. If you are a Consumer, the Australian Consumer Law provides you with certain rights that cannot be excluded, including that the Goods must be of acceptable quality, reasonably fit for the purpose that The Good Guys represents they will be fit for and that the Goods will correspond with any description. Nothing in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) which cannot by law be excluded, restricted or modified.
3.2 Our goods and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. You may recover damages from The Good Guys for any reasonably foreseeable loss or damage that you suffer because of any failure of a service or goods to comply with these guarantees, and:
- if the failure to comply with these guarantees for goods is a major failure or cannot be remedied, you are entitled to a replacement or refund. If a failure to comply with these guarantees for goods does not amount to a major failure you are entitled to request The Good Guys remedy the failure within a reasonable time and if The Good Guys fails to do so (by repairing the goods, replacing the goods or providing you with a refund);
- you may recover all reasonable costs you incur in having the failure remedied;
- you may (in certain circumstances) be entitled to reject the goods and claim a replacement or refund from The Good Guys; or
- if the failure to comply with these guarantees for a service is a major failure or cannot be remedied, you may terminate the agreement between you and The Good Guys for the supply of the service or recover from The Good Guys compensation for any reduction in the value of the service below the price paid or payable by you for the service. If a failure to comply with these guarantees for a service can be remedied and is not a major failure, you may request The Good Guys to remedy the failure within a reasonable time, and if it cannot be so remedied you may recover from The Good Guys all reasonable costs that you incur in having the failure remedied, or terminate your agreement with The Good Guys for the provision of the service.
4. Information about The Good Guys’ liability to you and your liability to The Good Guys
Except to the extent caused by The Good Guys’ negligence or breach of these Terms and Conditions, or as otherwise required by law, The Good Guys shall not be liable to you for any loss to you to the extent it is caused by: (i) your Account information being incomplete or inaccurate; (ii) any unauthorised use of your Password or Account which takes place before you notify The Good Guys; (iii) your Order information being incomplete or inaccurate; (iv) being unable to change or cancel your Order once it has been accepted by The Good Guys; (v) your Order not being received, being lost, misdirected or delayed as a result of the facility to place Orders being unavailable due to issues with the Website beyond the reasonable control of The Good Guys; (vi) cancellation of your Order; (vii) the availability of any Goods beyond the reasonable control of The Good Guys; (viii) delay in delivery of the Goods to you or delay in the availability of Goods for pick up in-store beyond the reasonable control of The Good Guys; (ix) any delay in you receiving any refund due to you beyond the reasonable control of The Good Guys; (x) any late, lost or misdirected deliveries of Goods beyond the reasonable control of The Good Guys; or (xi) any loss, damage, cost or expense suffered as a direct or indirect result of The Good Guys leaving the Goods in accordance with any “authority to leave” given by you, (xii) any breach of these Terms and Conditions by you; or (xiii) any other loss to the extent resulting from something outside of our control and within your control.
5. PRICING & TAXES
5.1 Prices for Goods are as shown on the Website.
5.2 The Good Guys reserves the right to change the prices of Goods at any time without notice to you. The price displayed at the time that you place your Order will continue to apply to you even if the price changes before your Order is accepted by The Good Guys.
5.3 In addition to the price for the Goods, you will also need to pay the listed delivery charge (if any) (“Delivery Charge”) for your Selected Delivery Option. Any Delivery Charge will appear in your shopping cart.
In addition to the price for the Goods and the Delivery Charge (if any) you may also need to pay any additional delivery charges which are not shown in your shopping cart but which we incur because you live in an area where light aircraft or barge transport is required, or to which our national courier company does not provide a door-to-door service (“Additional Delivery Charge”). These include, without limitation, Christmas Island, Norfolk Island, Roma and Nhulunbuy. Such charges may apply even where the item is shown on the Website as having “free delivery”, “free freight” or something similar. If you believe that you might live in such an area, you should contact Customer Service via commercialsupport@thegoodguys.com.au for more information.
5.4 By placing an Order you agree to pay the price for the Goods, any Delivery Charge and any Additional Delivery Charge.
6. YOUR ACCOUNT
6.1 Before placing an Order your Business must have a The Good Guys Business account created in the name of that Business.
6.2 In order for an individual to be able to order on behalf of a Business the individual must register his/her details as a representative of the Business.
6.3 All orders placed are made in the name of the relevant Business and not in the name of any individual acting on behalf of the Business.
6.4 Please ensure that you enter all information carefully when creating an Account. You warrant to The Good Guys that all information provided by you in relation to your Account is complete, true and accurate.
6.5 The Good Guys will provide you with a Password in order to access your Account. Passwords may also be used to allow you and/or your employees to access offers, opportunities and/or features associated with your Account. You must keep this Password confidential and only disclose it to such other persons as are specifically authorised by The Good Guys.
6.6 You must notify The Good Guys immediately if you become aware of any actual or potential unauthorised use of a Password associated with your Account or your Account itself.
6.7 Except for the extent caused by The Good Guys’ negligence or breach of these Terms and Conditions, if The Good Guys suffers any loss, damage, cost or expense as a result of any unauthorised use of a Password associated with your Account or your Account itself which takes place before you notify The Good Guys then you must pay The Good Guys the amount of that loss, damage, cost or expense if The Good Guys asks you to.
6.8 Please note that when you create an Account on the Website, you agree to subscribe to our marketing communications. You can unsubscribe at any time by the “unsubscribe” option in the relevant communication, for example, clicking on the unsubscribe link in the email you receive or texting the stated response word e.g. “STOP” or “UNSUB” or “REMOVE” to the mobile number in the SMS you receive.
6.9 You may not set up an account for someone else or for another Business.
6.10 The Good Guys may, in its sole discretion, terminate your Account or your use of the Website at any time without notice if you, or if The Good Guys suspects that you, are in material breach of these Terms and Conditions or if The Good Guys believes acting reasonably that this is necessary to protect you or The Good Guys from fraud or other unlawful or unauthorised use.
7. ORDERS
7.1 You can place an Order by following the instructions on the Website.
7.2 An Order submitted by you is an offer by you to purchase the Goods for the price plus the Delivery Charge as shown at the time of submission of your Order and any applicable Additional Delivery Charge. The Good Guys may accept or reject your offer in its absolute discretion. In particular, but without limitation, The Good Guys may reject Orders if you are not a commercial organisation or subject to any offer (e.g. family and friends of commercial customers) entitling you to purchase Goods from the Website. Please visit thegoodguys.com.au you wish to purchase goods from The Good Guys but are not eligible to do so via the Website.
7.3 Each Order that you place will, if accepted by The Good Guys, be a separate and binding agreement between you and The Good Guys with respect to the supply of the relevant Goods, in accordance with these Terms and Conditions.
7.4 If you place an Order for someone else to receive the Goods you must obtain their consent before providing The Good Guys with their personal information and, by placing an Order, you confirm to The Good Guys that you have done this.
7.5 Sale of Restricted Goods is subject to various Commonwealth, State and Territory laws. By placing an Order for any Restricted Goods you warrant to The Good Guys that you are:
- 18 years of age or older, where you Order products that are classified R18+;
- 15 years of age or older, where you Order products that are classified R15+.
When placing an Order for Restricted Goods you warrant that you are not obtaining the Restricted Goods on behalf of a person that is not eligible to purchase the Restricted Goods themselves.
7.6 Please ensure that you enter all information carefully when placing an Order. You warrant to The Good Guys that all information provided by you in relation to each Order is complete, true and accurate.
7.7 Please check your Order and Selected Delivery Option carefully (including the quantities ordered) before submitting it as Orders may not be able to be changed or cancelled once the Order has been accepted by The Good Guys. If you ask us to cancel or change your Order The Good Guys will use reasonable endeavours to cancel or change the Order if it has not already been shipped but makes no representation that it will be able to do this.
7.8 Where you place separate Orders the Goods will be delivered separately and a separate Delivery Charge (and Additional Delivery Charge if applicable) will apply to each Order. The Good Guys cannot consolidate separate Orders into one delivery.
7.9 Where you order more than one item in one Order, all Goods for which your Order is accepted at the same time will be dispatched together where practicable. However, in some cases Goods may be dispatched separately, for example: where the goods are being dispatched from different locations; or where the Goods are of different types (e.g. a mixture of hardware and software); or where the Goods have different availability statuses. Please note that a Delivery Charge is calculated based on several factors including the Good’s weight, dimensions, packaging, the number of delivery shipments required and the Selected Delivery Option.
7.10 The internet can be an unstable, and sometimes insecure, marketplace. At times the facility to place Orders may not be available, your Order might not be received, your Order may be lost or misdirected, or your Order might be delayed due to issues with the Website beyond the reasonable control of The Good Guys.
7.11 You must take your own precautions to ensure that the process which you employ for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer system and contains appropriate protection to prevent damage to your computer system caused by viruses, malicious computer code or other forms of interference.
7.12 You may only place an Order for Goods to be used in connection with your Business. You are not permitted to resell any Goods purchased unless authorised by The Good Guys in writing in advance. The unauthorised resale or attempted resale of any Goods will be considered a breach of these Terms and Conditions.
8. AFTER YOU HAVE SUBMITTED AN ORDER / PAYMENT
8.1 When you submit an Order you will receive an Order reference number via email.
8.2 The Good Guys will process payment for your Order when, or shortly after, you place your Order.
8.3 Upon receipt of an Order The Good Guys will email you an Order confirmation email containing the Order reference number, the price for the Goods, any Delivery Charge and any Additional Delivery Charge. At this point your Order has been accepted by The Good Guys subject to stock availability. A copy of your invoice will be available on the Order History page on your Account.
8.4 If The Good Guys is unable to fulfil your Order, it will send you an email cancelling your Order as soon as practicable. In this event, The Good Guys will refund any payment taken for your Order in accordance with Section 14.
8.5 When your Goods are dispatched The Good Guys will send you an email confirming that the Goods have been dispatched.
8.6 When The Good Guys accepts an Order it represents an agreement by The Good Guys to supply the Goods to you in accordance with your Order subject to receiving payment from you and subject to these Terms and Conditions.
8.7 You must pay for Goods by credit card, certain prepaid payment cards, PayPal account or any interest free plan available on the Website. Subject to any transaction value conditions stipulated by your Bank, you may also pay for those Goods using PayID (subject to your Bank’s Terms and Conditions).
8.8 You must not pay, or attempt to pay, for Goods through any fraudulent or unlawful means. If the name on the credit card/payment card/account does not match the name on the Order, The Good Guys may refuse to accept your order or ask you to provide additional information (for example, proof of identity documents) in accordance with its fraud detection processes. By providing your credit card/payment card/account or selecting one of the other available payment methods you authorise The Good Guys to deduct the price and the applicable Delivery Charge(s) from such card or payment methods.
8.9 The Good Guys reserves the right to change the payment methods that can be used for Orders at any time in its absolute discretion.
8.10 The Good Guys may not be able to, or may decline to, accept payment from you by your nominated payment method at any time for any reason including, without limitation: (a) where our fraud detection systems detect possible irregularities; (b) because your financial institution or other payment provider has declined payment; (c) because your payment card has expired; (d) because the Order would result in you exceeding the credit limit under your The Good Guys Business trade credit account; (d) where technical difficulties impact our ability to process payment; or (e) in any other situation if The Good Guys believes, acting reasonably, that this is necessary to protect you or The Good Guys from fraud or loss. Where this is the case, The Good Guys reserves the right to cancel your Order and/or place your Order on hold and request you to ask you to provide additional information (for example, proof of identity documents) or arrange payment by another method. If you are unable to comply with The Good Guys’ requests within the timescale specified, The Good Guys may cancel your Order.
8.11 When you submit an Order, The Good Guys may complete a pre-authorisation of the full value of the Order. A pre-authorisation is a practice of validating electronic transactions by holding the value of the Order unavailable until either the merchant charges the account or the transaction is cancelled. If an Order is cancelled (for example, because our fraud detection system has detected a possible irregularity), any pre-authorisation may still appear in your account as a pending transaction for a period of time, which will vary depending on your financial institution (e.g. 7 to 30 days). After such time, the funds will become available again for you to use.
8.12 Goods that you have ordered will not be dispatched to you until your payment for the Goods has cleared. If your payment cannot be processed, your Order will be rejected and we will notify you by email.
9. CANCELLATION OF ORDERS
9.1 The Good Guys reserves the right to cancel, at any time before delivery, an Order that it has previously accepted where:
- The Good Guys, acting in good faith, is unable to obtain sufficient quantities of stock to fulfill your Order within a reasonable timeframe;
- an event beyond The Good Guys’ control, such as storm, fire, flood, earthquake, terrorism, power failure, war, strike, pandemic, government action or problems with the Internet or third-party computer systems, means that The Good Guys is unable to supply the Goods within a reasonable time;
- Goods or services ordered were subject to an accidental error on the Website, for example, in relation to a description, price, reward or image, which was not discovered prior to the Order being dispatched;
- you ask The Good Guys to cancel your Order in accordance with Section 7.7;
- in the circumstances set out in Section 8.11; or
- you are paying for the Goods on your The Good Guys Business Credit Account and any payment due to The Good Guys by you is overdue.
9.2 You may cancel your Order where The Good Guys:
- has breached a material term of this Agreement; or
- is not able to deliver your Order within a reasonable time of the estimated delivery time listed on the Website for the applicable Selected Delivery Option, other than a result of any delay: (i) for which you are wholly or partly responsible such as a failure to provide the correct delivery address or to pay for the Goods.
9.3 Where The Good Guys cancels your order after acceptance it will send you and e-mail notifying you of the cancellation.
9.4 In the event The Good Guys, or you, cancelling your Order after payment has been processed, The Good Guys will refund any money paid in respect of that Order. Section 14of these Terms and Conditions sets out further information about refunds.
9.5 The Good Guys’ policy for change of mind returns does not apply to commercial Orders or Orders placed by a Business.
10. AVAILABILITY OF GOODS/REFURBISHED STOCK
10.1 As The Good Guys is dependent upon its Suppliers to provide stock, The Good Guys cannot guarantee availability at all times. You acknowledge and agree that, from time to time, certain Goods may be out of stock or unavailable. The Good Guys reserves the right to withdraw or suspend from sale any Goods displayed on the Website, either temporarily or permanently, at any time without notice to you.
10.2 After you place an Order, if there are any changes in available stock and The Good Guys is unable to fulfil your Order, you will be notified as soon as possible.
10.3 Goods that are shown on the Website as “Refurbished Stock” are Goods which have a cosmetic blemish or imperfection such as a scratch, dent or rub mark, have had a fault that has now been repaired by the manufacturer, or are ex-display models. All Refurbished Stock is in good working order and comes with the standard manufacturer’s warranty in addition to any statutory rights which may apply.
11. DELIVERY
11.1 When you place an Order for Goods to be delivered, you will be required to select one of the available Delivery Options for your Order (“Selected Delivery Option”). An estimated delivery time will be listed for your Selected Delivery Option. The Good Guys will use reasonable endeavours to deliver the Goods in your Order by the estimated delivery time for the Selected Delivery Option. If certain Goods in your Order are out of stock, the Selected Delivery Option will list different estimated delivery times for those out of stock Goods. Please note that the estimated delivery time for your Selected Delivery Option is an approximate delivery time only and is not a guaranteed delivery time for your Order.
11.2 Until full payment in cleared funds is received by The Good Guys for all Goods supplied by it to the you, legal title and property in all Goods supplied under this contract remain vested in The Good Guys and does not pass to the you.
11.3 Risk in the Goods passes to you on the date and time of delivery of the Goods to the delivery address provided in your Order.
11.4 Goods will generally only be delivered to addresses within Australia. The Good Guys is unable to deliver to certain parts of Australia and where this is the case you will not be able to process your Order. The Good Guys may, in its absolute discretion, agree to accept Orders for delivery outside Australia but is under no obligation to do so. Goods will not be delivered to a PO Box or Parcel Locker. .
11.5 Delivery of Goods (in particular large Goods such as televisions, large kitchen appliances, laundry appliances and air conditioners) to parts of Australia such as the Northern Territory, Western Australia, Tasmania, remote/isolated areas and island communities may have extended delivery times and are subject to local transport schedules. Goods may also have to be collected from the closest local barge or freight company, in which case you will be responsible for arranging final delivery (including any additional cost for such final delivery) with the barge or freight company to your nominated address. If additional charges from a third party apply to your Order, TGG will contact you prior to delivery to advise such charges.
11.6 Following dispatch of your Goods, The Good Guys will email you with confirmation of dispatch and an invoice for your Order.
11.7 Installation of the Goods is not included as part of the Delivery Charge. Please click here for more information on installation services.
11.8 If you request multiple delivery dates for an Order, The Good Guys may charge separate Delivery Charges for each delivery.
11.9 Not all delivery options described in this section are available for all Orders or on all Accounts.
Parcel Delivery
11.10 Where requested, The Good Guys will deliver to PO Boxes or Postal Lockers in Australia where possible based on the size of the Goods. Where it is not possible to deliver the Goods to a PO Box or Postal Locker and you have input a PO Box or Postal Locker as the delivery address when placing your Order, The Good Guys will call you to arrange an alternative delivery address.
11.11 On delivery you may be required to sign a proof of delivery document. If you are not available to take delivery, we will, at our discretion, either:
- take your Goods to our delivery service provider’s local depots;
- ask you if you are willing to give us “authority to leave” the Goods at a place that you believe is safe at, or outside, the delivery address;
- take your Goods to a The Good Guys nominated alternate delivery point that is close to your delivery address (e.g. pharmacy, petrol station, post office or newsagent); or
- re-deliver your Goods to your delivery address at a later date.
You will receive a text message and/or a calling card at your delivery address containing details of the local depot, alternate delivery point or contact details for you to arrange for re-delivery of your Goods. Please note that if you do not pick up your Goods from the nominated alternate delivery point within the period specified in the text message and/or calling card, your Goods will be taken to one of our delivery service provider’s local depots for you to pick up at your convenience. If you provide “authority to leave”, we will leave the Goods at the agreed place. Risk and title in Goods passes to you at this time and you will bear the risk of any loss or theft of the Goods.
11.12 If you require Goods that you have ordered to be re-directed to an address which is not the original Order address, and such Goods have already been dispatched, The Good Guys will use reasonable endeavours to re-direct the Goods to your requested address and may charge you a reasonable fee for doing this.
On Demand Delivery
11.13 When you request On Demand Delivery you may be required to confirm if you will be at home at the time of the delivery or otherwise provide us with “authority to leave” and we will leave the Goods in the agreed place. Unless you have provided us with such “authority to leave”, on delivery you may be required to sign a proof of delivery document or provide the PIN sent to you in the confirmation SMS or email for your Order, or at the time you place your Order. If you have not provided us with “authority to leave” and you are not available to take delivery, your Goods will be returned to the store or our Distribution Centre and we will contact you to arrange for collection by you or re-delivery. If you provide us with “authority to leave”, delivery will be deemed to have occurred when we leave the Goods in the agreed place (and in accordance with section 11.2, risk in Goods passes to you at this time and you will bear the risk of any loss or theft of the Goods from this time onwards).
11.14 If you want to change the delivery date The Good Guys require a minimum of 24 hours’ notice prior to delivery.
Door to Door
11.15 Door to Door delivery is TGG’s standard delivery service where your Goods will be delivered to your Premises. Door to Door delivery is available to most locations in Australia and Tasmania.
11.16 On the Website, the postcode search bar on the delivery page, product page or in the shopping cart will confirm the cost of Door to Door delivery to your area based on the Goods, your postcode and the delivery zone that it falls in.
11.17 In addition to these Terms and Conditions, if your Goods are being delivered, TGG’s Home Delivery Terms of Sale will apply. For TGG’s Home Delivery Terms of Sale please visit our Home Delivery Terms and Conditions. If there is any inconsistency between these Terms and Conditions and TGG’s Home Delivery Terms of Sale, these Terms and Conditions will prevail to the extent of any inconsistency.
Premium Delivery
11.18 Premium delivery is TGG’s upgraded delivery service. TGG will deliver your Goods, unbox the Goods, remove any packaging, as well as take away any old product.
11.19 Premium delivery is available on all whitegoods, kitchen appliances, laundry appliances, air conditioners, desktop computers and selected small household appliances.
11.20 The postcode search bar on the delivery page, product page or in the shopping cart on the Website will confirm if Premium Delivery can be provided to your area for the particular Goods. The cost of Premium Delivery is based on the Goods, your postcode and the delivery zone that it falls in. Standard charges apply for single storey dwelling. Additional charges may apply for dwellings with stairs.
11.21 In addition to these Terms and Conditions, if your Goods are being delivered, TGG’s Home Delivery Terms of Sale will apply. For TGG’s Home Delivery Terms of Sale please visit our Home Delivery Terms and Conditions. If there is any inconsistency between these Terms and Conditions and TGG’s Home Delivery Terms of Sale, these Terms and Conditions will prevail to the extent of any inconsistency..
Big and Bulky Delivery
11.22 For delivery of big and bulky items, The Good Guys’ Big and Bulky Delivery Terms and Conditions will also apply. If there is any inconsistency between these Terms and Conditions and The Good Guys’ Big and Bulky Delivery Terms and Conditions , these terms will prevail to the extent of any inconsistency.
Vendor or Distributor Delivery
11.23 If the Goods the subject of a delivery are to be delivered to you directly from one of The Good Guys’ distributors, suppliers and/ or vendors (“Direct Delivery”), then the terms and conditions applicable to that Direct Delivery will be the delivery terms and conditions of that relevant distributor, supplier and/ or vendor, as the case may be.
Pre-Orders
11.24 The Good Guys’ arrangements with its suppliers means that The Good Guys is only permitted to dispatch online Pre-Orders no earlier than one day prior to the official release date of the Goods offered for Pre-Order. Goods ordered:
- up to 7 days prior to the official release date are (unless otherwise advised) guaranteed to be despatched from our warehouse no later than one day prior to the official release date, and will be delivered to your designated delivery address within Australia in accordance with your Selected Delivery Option for those Goods. If you have chosen to pick up those Goods in-store (i.e. the Click & Collect option) you can pick up the Goods at your nominated collection store on the release date; or
- within 7 days prior to the official release date may only be despatched on or after the official release date. If you have chosen to pick up those Goods in store, the Goods may only be available to pick up at your nominated collection store after the release date.
12. Click & Collect
12.1 Many Goods can be picked up from a The Good Guys store, or where the Goods are “big and bulky”, from a Distribution Centre, rather than being delivered to you. Where you wish to do this you will need to select this option when you place your Order. Please note that some Goods are not available for pick up from store or a Distribution Centre.
12.2 Only the person named on the relevant Order confirmation may pick-up the Goods in-store or from a Distribution Centre, unless “Friend pick-up” (where you nominate another person to pick-up your Goods) was selected when the Order was placed.
12.3 If you choose to pick up your Order in store, once The Good Guys has confirmed that the Order is available for pick up, you may pick up the Order:
- during the business hours of your nominated collection store; or
- the next business day if your Order is confirmed less than 1 hour before the close of trading hours for the nominated store.
12.4 If you choose to pick up your Goods from a Distribution Centre, your Order should be available for pick up from the Distribution Centre at any time after you place your Order during the Distribution Centre’s opening hours. Collection of your Order may take up to twenty minutes at busy times.
12.5 When picking up Goods in store or at a Distribution Centre:
- you must provide photo identification (current drivers licence, passport or any government issued photo ID card) to store staff to verify that the purchaser. If requested, you must allow The Good Guys to take a copy of this identification for fraud prevention purposes. The copy will not be used by The Good Guys for any other purpose;
- The Good Guys staff may also check your signature against the signature on any credit/debit/payment card used to purchase the Goods. You must therefore ensure that you bring this card when picking up the Goods;
- if you paid using PayPal, you will also need your PayPal Transaction ID;
- you will also need to bring the email that The Good Guys has sent to you confirming that the Goods are available for pick-up; and
- The Good Guys staff have the right to refuse collection of Goods if you cannot or will not satisfy the requirements set out above. In this event The Good Guys will contact the person who placed the Order using the contact details provided.
12.6 In respect of the estimated time for collection, references to “same day” or “next day” on the Website exclude public holidays where The Good Guys does not trade in the State or Territory of your nominated collection store.
12.7 The Good Guys reserves the right to allocate Goods that are not collected within 28 days of the date of your Order to another customer order and to reorder the Goods for you.
12.8 If you fail to collect the Goods within 28 days of the date of your Order, at The Good Guys’ discretion, The Good Guys may agree to hold the Goods for a longer period subject to a daily storage fee.
12.9 When picking up “big and bulky” Goods at a Distribution Centre or in-store:
- you must ensure your vehicle is appropriate for transporting your Goods. The law requires that the Goods are adequately restrained so you should bring appropriate restraints to safely secure your load;
- your Order confirmation must be presented for collection, and you will be asked to sign that you have received your Goods in good condition;
- manufacturers usually recommend that TVs & whitegoods are transported upright to avoid damage. The Good Guys accepts no responsibility for any loss, damage or liability suffered by you due to the way in which the Goods are loaded or transported by you. The Good Guys team members may help to load Goods into your vehicle (but not onto the roof or roof racks) if requested and they believe it is safe to do so, and may provide suggestions to you as to ways to transport your Goods in order to avoid damage. However, you are entirely responsible for ensuring that the Goods are loaded and transported in accordance with relevant road traffic/safety laws and in a way which does not result in damage to the Goods;
- The Good Guys does not provide forklifts when loading and will not assist with roof top loading;
- if you have any concerns about picking-up your Goods, please call your store to arrange delivery.
13. DELAY IN AVAILABILITY OR DELIVERY OF GOODS
13.1 You agree and acknowledge that:
- The Good Guys does not guarantee the dispatch or delivery or availability of Goods within timeframes, estimated delivery times listed for the Delivery Options or the Selected Delivery Option for your Order, or any other timeframes or otherwise specified by The Good Guys or any of its staff;
- stock availability and events outside The Good Guys’ control (including adverse weather conditions, traffic conditions and governmental action) may cause delays, or in some circumstances, prevent your Goods from being delivered or available for pick-up in-store or at a Distribution Centre;
- delays are particularly likely to occur during busy sale periods such as those around Black Friday, Christmas, Easter and public holidays; and
- if you are paying for the Goods on your The Good Guys Business Credit Account and any payment due to The Good Guys by you is overdue, then The Good Guys may (without any liability to you) choose to delay delivery of any Goods that have been ordered by you but not yet delivered to you, despite the fact that The Good Guys has previously accepted the order for those Goods.
14. REFUNDS OF YOUR MONEY
14.1 Where The Good Guys is obliged to refund your payment pursuant to these Terms and Conditions, The Good Guys aims to initiate your refund to your original payment method(s) within 2 business days (Monday – Friday 9 a.m. to 5 p.m. Melbourne time). The additional time that it takes for you to actually receive your refund will depend upon how quickly your financial institution or other payment provider processes the refund. Please note that if The Good Guys is obliged to provide you a partial refund of your payment for specific Goods in your Order, we will only refund the component of the Delivery Charge relating to the Goods which are subject to the refund.
14.2 Where The Good Guys is obliged to refund your payment pursuant to these Terms and Conditions and you have paid for the relevant Order using your The Good Guys Business Credit Account The Good Guys will credit your The Good Guys Business Credit Account.
15. RETURNS/FAULTY OR DAMAGED GOODS
15.1 You should check your Goods as soon as they are delivered to you in order to ensure that: (i) they are what you ordered; and (ii) they are not damaged or faulty. If this is not the case you should contact The Good Guys on commercialsupport@thegoodguys.com.au as soon as possible. Where you are not a Consumer, if you fail to give notice to The Good Guys of any problem or defect with the Order within 7 days of delivery, The Good Guys reserves the right (acting reasonably and in good faith) not to accept return of the Goods or any liability for any alleged damage.
15.2 Except to the extent otherwise required by law or where the Goods are faulty (in which case Sections 15.5-15.7 apply), all returns of goods that have been correctly delivered to you in accordance with an Order must be approved in writing by The Good Guys (“Approved Returns”). The Good Guys reserves its absolute discretion to accept or reject requests for return of such Goods. Except to the extent otherwise required by law or where the Goods are faulty (in which case Sections 15.5 -15.7 apply), bespoke, indent or customer Orders will not be accepted for return under any circumstances. Approved Returns must be freight prepaid by you. The Good Guys will credit or refund you for Approved Returns only if they are in saleable condition (as reasonably determined by The Good Guys) upon return and then only upon conditions acceptable to The Good Guys and at your entire cost and provided the goods are and remain sealed in a manner in which they were delivered and accompanied by documentation showing:
- customer name, address and account number;
- invoice number; and
- the reason for return and copy of approval issued by The Good Guys.
Approved Returns are at your risk as to loss or damage until such time as the goods reach The Good Guys’ place of business.
15.3 Our goods usually come with warranties from the manufacturer. Your rights under these warranties are governed by the specific terms of the warranty. The Good Guys has no liability to you in respect of such warranties
15.4 Except where you are a Consumer, The Good Guys is not liable for any loss (including special, indirect or consequential loss, loss of profits, loss of business, loss of reputation, loss of goodwill, loss of opportunity arising or loss caused by the negligence of The Good Guys) suffered or incurred by you in connection with any act or omission of The Good Guys in relation to an Order.
15.5 In respect of goods supplied under these Terms and Conditions, subject to Section 15.6, if you are a Consumer and are purchasing goods which are not of a kind ordinarily acquired for personal, domestic or household use or consumption, the liability of The Good Guys for loss, however caused (including by the negligence of The Good Guys), suffered or incurred by you because of a failure to comply with a Consumer Guarantee is limited to The Good Guys (at its election):
- replacing the goods or supplying equivalent goods;
- repairing the goods;
- paying the cost of replacing the goods or of acquiring equivalent goods; or
- paying the cost of having the goods repaired.
15.6 Section 15.5 does not apply if it is not fair or reasonable for The Good Guys to rely on them, if the goods are Consumer Goods, or in relation to Title Guarantees.
15.7 When you are entitled to return faulty Goods:
- please provide The Good Guys with your proof of purchase;
- it is a requirement for the fulfilment of refunds, exchanges and warranties that you use their best endeavours to return all out-of-the-box accessories (such as power cords and batteries) supplied at the time of original purchase.
You are also encouraged to use the original packaging where possible in order to avoid damage in transit.
15.8 You are not entitled to any refund or exchange just because any packaging is damaged in transit. The packaging exists to protect the Goods themselves.
15.9 If Goods are unused but have been unpacked, we may, at our absolute discretion, accept return of the Goods in the event of a change of mind provided they are in perfect condition. However, in such cases we will not refund any Delivery Charge, and you must pay for us to pick up the goods if you are unable to return the Goods to a The Good Guys store and we will apply a restocking fee equal to 20% of the original purchase price.
16. PRIVACY
16.1 The Good Guys policy on the collection, use and disclosure of customers’ personal information is set out in its Privacy Policy which forms part of these Terms and Conditions.
17. COMMISSIONS PAID FOR SALES AND LEAD GENERATIONS
17.1 From time to time The Good Guys may pay third parties and affiliate partners commissions for referrals leading to sales and/or lead generation. The Good Guys currently pay commissions to a number of third parties and affiliate partners.
18. AGENCY PRODUCTS
18.1 The Good Guys act as an agent on behalf of the manufacturer/suppliers listed below. Agency products refer to The Good Guys as an “agent” on the product pages. Agency products are shipped directly from the manufacturer/supplier to the customer. When you purchase an agency product you are subject to their terms and conditions of sale below. From time to time, The Good Guys receives commissions acting as an agent on behalf of the manufacturer/supplier.
19. WEBSITE TERMS
19.1 Your use of the Website is governed by the Website Terms of Use.
20. GENERAL
20.1 Subject to section 20.2 and to any terms implied by law (including, without limitation, the Consumer Guarantees under the Australian Consumer Law), unless The Good Guys otherwise agrees in writing, these Terms and Conditions are the only terms which shall apply to Goods supplied pursuant to an Order on the Website.
20.2 If you hold a credit account with The Good Guys and are party to the Terms and Conditions of Credit, these Terms and Conditions will apply in conjunction with the Terms and Conditions of Credit. To the extent of any inconsistency between these Terms and Conditions and the Terms and Conditions of Credit, the Terms and Conditions of Credit will prevail.
20.3 The Good Guys reserves the right to amend these Terms and Conditions at any time. Any amendment will take effect from the time that it appears on the Website. The terms and conditions which apply at the time that you place your Order are the terms and conditions which will apply to your Order.
20.4 You agree that these Terms and Conditions will in all circumstances prevail over any terms and conditions of purchase of yours (if any) and override any quotes, invoices or other documentation (including, without limitation, any terms and conditions attached or forming part of any purchase order of yours) exchanged between the parties whether or not such documents expressly provide that they override these Terms and Conditions.
20.5 Each of the rights and remedies available to The Good Guys as set out in these Terms and Conditions shall be in addition to, and shall not derogate from, any other rights and remedies available including, without limitation, under contract, in tort, under statute, in equity or for specific performance.
20.6 Any provision in this agreement which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise shall be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of this agreement or affecting the validity or enforceability of that provision in any other jurisdiction.
20.7 These Terms and Conditions are governed by the laws of Victoria, Australia.
21. DEFINITIONS
In Sections 21 to 39 of these Terms and Conditions:
“Account” means a personal account created by you on the The Good Guys Business Website or portal as applicable;
“Additional Delivery Charge” has the meaning given in Section 0;
“Big and Bulky Delivery” means a Delivery Option where the Goods to be delivered are “big and bulky” goods;
“Delivery Charge” has the meaning given in Section 24.3;
“Delivery Options” means the delivery options available for an Order which are listed on the Website, as updated from time to time. The delivery options available for an Order will vary depending on factors such as the nature of the Goods you are purchasing and your delivery address. Delivery options may include: Standard Delivery; Express Delivery; Australia Post eParcel; Courier Delivery; Unpack & Connect (selected bulky goods); and Premium Delivery (selected bulky goods). Delivery Charges and estimated delivery times may vary for each Delivery Option;
“Distribution Centre” means a The Good Guys distribution centre open to the public for pre-arranged pre-paid order collections;
“Order” means an order for Goods, placed on the Website;
“Password” means any password needed to access your Account or any offer, opportunity or feature associated with your Account;
“Premises” means the premises specified by you for delivery;
“Restricted Goods” means Goods which are only intended to be viewed, played, listened to or otherwise utilised by a person of at least a certain age; and
“Title Guarantee” means a guarantee pursuant to any of section 51, 52 or 53 of the Australian Consumer Law;
“Selected Delivery Option” has the meaning given in Section 30.1; and
“Website” means commercial.thegoodguys.com.au.
22. YOU AND YOUR LEGAL RIGHTS UNDER THE CONSUMER GUARANTEES PROVIDED BY THE AUSTRALIAN CONSUMER LAW
22.1 By placing an Order you warrant that you are an individual acquiring the Goods wholly or predominantly for personal, domestic or household use or consumption.
22.2 Your purchase of Goods will be subject to certain laws including, without limitation, the Australian Consumer Law. The Australian Consumer Law provides you with certain rights that cannot be excluded, including that the Goods must be of acceptable quality, reasonably fit for the purpose that The Good Guys represents they will be fit for and that the Goods will correspond with any description. Nothing in these Terms and Conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) which cannot by law be excluded, restricted or modified.
22.3 Our goods and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. You may recover damages from The Good Guys for any reasonably foreseeable loss or damage that you suffer because of any failure of a service or goods to comply with these guarantees, and:
- if the failure to comply with these guarantees for goods is a major failure or cannot be remedied, you are entitled to a replacement or refund. If a failure to comply with these guarantees for goods does not amount to a major failure you are entitled to request The Good Guys remedy the failure within a reasonable time and if The Good Guys fails to do so (by repairing the goods, replacing the goods or providing you with a refund);
- you may recover all reasonable costs you incur in having the failure remedied;
- you may (in certain circumstances) be entitled to reject the goods and claim a replacement or refund from The Good Guys; or
- if the failure to comply with these guarantees for a service is a major failure or cannot be remedied, you may terminate the agreement between you and The Good Guys for the supply of the service or recover from The Good Guys compensation for any reduction in the value of the service below the price paid or payable by you for the service. If a failure to comply with these guarantees for a service can be remedied and is not a major failure, you may request The Good Guys to remedy the failure within a reasonable time, and if it cannot be so remedied you may recover from The Good Guys all reasonable costs that you incur in having the failure remedied, or terminate your agreement with The Good Guys for the provision of the service.
23. INFORMATION ABOUT THE GOOD GUYS’S LIABILITY TO YOU AND YOUR LIABILITY TO THE GOOD GUYS
23.1 Save as otherwise provided by law and, except to the extent caused by The Good Guys’ negligence or breach of these Terms and Conditions, The Good Guys shall not be liable to you for any loss to you to the extent it is caused by: (i) your Account information being incomplete or inaccurate; (ii) any unauthorised use of your Password or Account which takes place before you notify The Good Guys; (iii) your Order information being incomplete or inaccurate; (iv) being unable to change or cancel your Order once it has been accepted by The Good Guys; (v) your Order not being received, being lost, misdirected or delayed as a result of the facility to place Orders being unavailable due to issues with the Website beyond the reasonable control of The Good Guys; (vi) cancellation of your Order; (vii) delay in delivery of the Goods to you or delay in the availability of Goods for pick up in-store beyond the reasonable control of The Good Guys; (viii) any delay in you receiving any refund due to you beyond the reasonable control of The Good Guys; (ix) any late, lost or misdirected deliveries of Goods beyond the reasonable control of The Good Guys; or (x) any loss, damage, cost or expense suffered as a direct or indirect result of The Good Guys leaving the Goods in accordance with any “authority to leave” given by you; (xi) any breach of these Terms and Conditions by you; or (xii) any other loss to the extent resulting from something outside of our control and within your control, whether such losses arise in contract, tort, under statute or regulation, or under any other legal cause of action, claim or right.
24. PRICING & TAXES
24.1 Prices for Goods are as shown on the Website.
24.2 The Good Guys reserves the right to change the prices of Goods at any time without notice to you. The price displayed at the time that you place your Order will continue to apply to you even if the price changes before your Order is accepted by The Good Guys.
24.3 In addition to the price for the Goods, you will also need to pay the listed delivery charge (if any) (“Delivery Charge”) for your Selected Delivery Option. Any Delivery Charge will appear in your shopping cart.
24.4 In addition to the price for the Goods and the Delivery Charge (if any) you may also need to pay any additional delivery charges which are not shown in your shopping cart but which we incur because you live in an area where light aircraft or barge transport is required, or to which our national courier company does not provide a door-to-door service (“Additional Delivery Charge”). These include, without limitation, Christmas Island, Norfolk Island, Roma and Nhulunbuy. Such charges may apply even where the item is shown on the Website as having “free delivery”, “free freight” or something similar. If you believe that you might live in such an area, you should contact Customer Service via commercialsupport@thegoodguys.com.aufor more information.
24.5 If you live in an area to which an Additional Delivery Charge will apply The Good Guys will contact you before accepting your Order and provide you with a quote for the Additional Delivery Charge. If, within the timescale specified, you do not agree to accept the Additional Delivery Charge, The Good Guys will cancel your Order. The Good Guys will not take payment for your Order until you have confirmed your acceptance of the Additional Delivery Charge.
24.6 By placing an Order you agree to pay the price for the Goods, any Delivery Charge and any Additional Delivery Charge.
24.7 All prices and Delivery Charges and Additional Delivery Charges quoted are in Australian dollars and are inclusive of GST.
25. YOUR ACCOUNT
25.1 You may choose to create an Account on the Website before placing an Order. You do not have to create an Account before placing an Order. Certain Goods may only be available to Account holders.
25.2 You may not set up an Account for someone else. Your account must be in your individual name and not in the name of any partnership, company, trust, institution (including a school) or a government body.
25.3 Please ensure that you enter all information carefully when creating an Account. You warrant to The Good Guys that all information provided by you in relation to your Account is complete, true and accurate.
25.4 The Good Guys will provide you with a Password in order to access your Account. You must keep this Password confidential and must not disclose it to any other person. You may also receive one or more Passwords from your employer or another Account holder which can be used to allow you to access offers, opportunities and/or features associated with your employer’s or that third party’s Account. You must keep this Password confidential and not disclose it to any other person.
25.5 You must notify The Good Guys immediately if you become aware of any actual or potential unauthorised use of a Password or Account.
25.6 Please note that when you create an Account on the Website, you agree to subscribe to our marketing communications. You can unsubscribe at any time by the “unsubscribe” option in the relevant communication, for example, clicking on the unsubscribe link in the email you receive or texting the stated response word e.g. “STOP” or “UNSUB” or “REMOVE” to the mobile number in the SMS you receive.
25.7 You may not set up an account for someone else or for another Business.
25.8 The Good Guys may, in its sole discretion, terminate or suspend your Account if The Good Guys believes acting reasonably that this is necessary to protect you or The Good Guys from fraud or other unlawful or unauthorised use.
26. ORDERS
26.1 You can place an Order by following the instructions on the relevant The Good Guys website.
26.2 An Order submitted by you is an offer by you to purchase the Goods for the price plus the Delivery Charge as shown at the time of submission of your Order and any applicable Additional Delivery Charge. The Good Guys may accept or reject your offer in its absolute discretion. In particular, but without limitation, The Good Guys may reject Orders from individuals who are not entitled to us the Website by virtue of their status or under a special offer. If you are not entitled to use the Website please visit thegoodguys.com.au to purchase Goods from The Good Guys.
26.3 Each Order that you place will, if accepted by The Good Guys, be a separate and binding agreement between you and The Good Guys with respect to the supply of the relevant Goods, in accordance with these Terms and Conditions.
26.4 If you place an Order for someone else to receive the Goods you must obtain their consent before providing The Good Guys with their personal information and, by placing an Order, you confirm to The Good Guys that you have done this.
26.5 Sale of Restricted Goods is subject to various Commonwealth, State and Territory laws. By placing an Order for any Restricted Goods you warrant to The Good Guys that you are:
- 18 years of age or older, where you Order products that are classified R18+; and
- 15 years of age or older, where you Order products that are classified R15+.
When placing an Order for Restricted Goods you warrant that you are not obtaining the Restricted Goods on behalf of a person that is not eligible to purchase the Restricted Goods themselves.
26.6 Please ensure that you enter all information carefully when placing an Order. You warrant to The Good Guys that all information provided by you in relation to each Order is complete, true and accurate.
26.7 Please check your Order and Selected Delivery Option carefully (including the quantities ordered) before submitting it as Orders may not be able to be changed or cancelled once the Order has been accepted by The Good Guys. If you ask us to cancel or change your Order The Good Guys will use reasonable endeavours to cancel or change the Order if it has not already been shipped but makes no representation that it will be able to do this.
26.8 Where you place separate Orders the Goods will be delivered separately and a separate Delivery Charge (and Additional Delivery Charge if applicable) will apply to each Order. The Good Guys cannot consolidate separate Orders into one delivery.
26.9 Where you order more than one item in one Order, all Goods for which your Order is accepted at the same time will be dispatched together where practicable. However, in some cases Goods may be dispatched separately, for example: where the goods are being dispatched from different locations; or where the Goods are of different types (e.g. a mixture of hardware and software); or where the Goods have different availability statuses. Please note that a Delivery Charge is calculated based on several factors including the Good’s weight, dimensions, packaging, the number of delivery shipments required and the Selected Delivery Option.
26.10 The internet can be an unstable, and sometimes insecure, marketplace. At times the facility to place Orders may not be available, your Order might not be received, your Order may be lost or misdirected, or your Order might be delayed.
26.11 You must take your own precautions to ensure that the process which you employ for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer system and contains appropriate protection to prevent damage to your computer system caused by viruses, malicious computer code or other forms of interference.
26.12 You may only place an Order for Goods to be used in connection with your Business or for your personal use. You are not permitted to resell any Goods purchased unless authorised by The Good Guys in writing in advance. The unauthorised resale or attempted resale of any Goods will be considered a breach of these Terms and Conditions.
27. AFTER YOU HAVE SUBMITTED AN ORDER / PAYMENT
27.1 When you submit an Order you will receive an Order reference number via email.
27.2 The Good Guys will process payment for your Order when, or shortly after, you place your Order.
27.3 Upon receipt of an Order The Good Guys will email you an Order confirmation email containing your Order reference number, the price for the Goods, any Delivery Charge and any Additional Delivery Charge. At this point your Order has been accepted by The Good Guys subject to stock availability. A copy of your invoice will be available on the Order History page on your Account.
27.4 If The Good Guys is unable to fulfil your Order it will send you an email cancelling your Order as soon as practicable. In this event, The Good Guys will refund any payment taken for your Order in accordance with Section 33.
27.5 When your Goods are dispatched The Good Guys will send you an email confirming that the Goods have been dispatched.
27.6 When The Good Guys accepts an Order it represents an agreement by The Good Guys to supply the Goods to you in accordance with your Order subject to receiving payment from you and subject to these Terms and Conditions.
27.7 You must pay for Goods by credit card, certain prepaid payment cards, PayPal account or any interest free plan available on the Website. Subject to any transaction value conditions stipulated by your Bank, you may also pay for those Goods using PayID (subject to the relevant Bank’s Terms and Conditions).
27.8 You must not pay, or attempt to pay, for Goods through any fraudulent or unlawful means. If the name on the credit card/payment card/account does not match the name on the Order, The Good Guys may refuse to accept your order or ask you to provide additional information (for example, proof of identity documents) in accordance with its fraud detection processes. By providing your credit card/payment card/account or selecting one of the other available payment methods you authorise The Good Guys to deduct the price and the applicable Delivery Charge(s) from such card or payment methods.
27.9 The Good Guys reserves the right to change the payment methods that can be used for Orders at any time in its absolute discretion.
27.10 The Good Guys may not be able to, or may decline to, accept payment from you by your nominated payment method: (a) where our fraud detection systems detect possible irregularities; (b) because your financial institution or other payment provider has declined payment; (c) because your payment card has expired; or (d) because the Order would result in you exceeding the credit limit under your The Good Guys Business trade credit account; (e) where technical difficulties impact our ability to process payment; or (f) in any other situation if The Good Guys believes, acting reasonably, that this is necessary to protect you or The Good Guys from fraud or loss.
Where this is the case, The Good Guys reserves the right to cancel your Order and/or place your Order on hold and request you to ask you to provide additional information (for example, proof of identity documents) or arrange payment by another method. If you are unable to comply with The Good Guys’ requests within the timescale specified, The Good Guys may cancel your Order.
27.11 When you submit an Order, The Good Guys may complete a pre-authorisation of the full value of the Order. A pre-authorisation is a practice of validating electronic transactions by holding the value of the Order unavailable until either the merchant charges the account or the transaction is cancelled. If an Order is cancelled (for example, because our fraud detection system has detected a possible irregularity), any pre-authorisation may still appear in your account as a pending transaction for a period of time, which will vary depending on your financial institution (e.g. 7 to 30 days). After such time, the funds will become available again for you to use.
27.12 Goods that you have ordered will not be dispatched to you until your payment for the Goods has cleared. If your payment cannot be processed, your Order will be rejected and we will notify you by email.
28. CANCELLATION OF ORDERS
28.1 The Good Guys reserves the right to cancel, at any time before delivery, an Order that it has previously accepted where:
- The Good Guys, acting in good faith, is unable to obtain sufficient quantities of stock to fulfill your Order within a reasonable timeframe;
- an event beyond The Good Guys’ control, such as storm, fire, flood, earthquake, terrorism, power failure, war, strike, pandemic, government action or failure or problems with the Internet or third-party computer systems, means that The Good Guys is unable to supply the Goods within a reasonable time;
- Goods or services ordered were subject to an accidental error on the Website, for example, in relation to a description, price, reward or image, which was not discovered prior to the Order being dispatchyou ask The Good Guys to cancel your Order in accordance with Section 26.7; or
- in the circumstances set out in Sections 24.5 or 3.1.
28.2 You may cancel your Order where The Good Guys:
- has breached a material term of this Agreement; or
- is not able to deliver your Order within a reasonable time of the estimated delivery time listed on the Website for the applicable Selected Delivery Option, other than a result of any delay: (i) for which you are wholly or partly responsible such as a failure to provide the correct delivery address or to pay for the Goods.
28.3 Where The Good Guys cancels your order after acceptance it will send you and e-mail notifying you of the cancellation.
28.4 In the event The Good Guys, or you, cancelling your Order after payment has been processed, The Good Guys will refund any money paid in respect of that Order. Section 33of these Terms and Conditions sets out further information about refunds.
29. AVAILABILITY OF GOODS/REFURBISHED STOCK
29.1 As The Good Guys is dependent upon its Suppliers to provide stock, The Good Guys cannot guarantee availability at all times. You acknowledge and agree that, from time to time, certain Goods may be out of stock or unavailable. The Good Guys reserves the right to withdraw or suspend from sale any Goods displayed on the Website, either temporarily or permanently, at any time without notice to you. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), The Good Guys will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of the unavailability of any Goods at any time, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.
29.2 After you place an Order, if there are any changes in available stock and The Good Guys is unable to fulfil your Order, you will be notified as soon as possible.
29.3 Goods that are shown on the Website as “Refurbished Stock” are Goods which have a cosmetic blemish or imperfection such as a scratch, dent or rub mark, have had a fault that has now been repaired by the manufacturer, or are ex-display models. All Refurbished Stock is in good working order and comes with the standard manufacturer’s warranty in addition to any statutory rights which may apply.
30. DELIVERY
30.1 When you place an Order for Goods to be delivered, you will be required to select one of the available Delivery Options for your Order (“Selected Delivery Option”). An estimated delivery time will be listed for your Selected Delivery Option. The Good Guys will use reasonable endeavours to deliver the Goods in your Order by the estimated delivery time for the Selected Delivery Option. If certain Goods in your Order are out of stock, the Selected Delivery Option will list different estimated delivery times for those out of stock Goods. Please note that the estimated delivery time for your Selected Delivery Option is an approximate delivery time only and is not a guaranteed delivery time for your Order.
30.2 Title and risk in the Goods passes to you on the date and time of delivery of the Goods to the delivery address provided in your Order.
30.3 Goods will generally only be delivered to addresses within Australia. The Good Guys is unable to deliver to certain parts of Australia and where this is the case you will not be able to process your Order. The Good Guys may, in its absolute discretion, agree to accept Orders for delivery outside Australia but is under no obligation to do so. Goods will not be delivered to a PO Box or Parcel Locker.
30.4 Delivery of Goods (in particular large Goods such as televisions, large kitchen appliances, laundry appliances and air conditioners) to parts of Australia such as the Northern Territory, Western Australia, Tasmania, remote/isolated areas and island communities may have extended delivery times and are subject to local transport schedules. Goods may also have to be collected from the closest local barge or freight company, in which case you will be responsible for arranging final delivery (including any additional cost for such final delivery) with the barge or freight company to your nominated address. If additional charges from a third party apply to your Order, TGG will contact you prior to delivery to advise such charges.
30.5 Following dispatch of your Goods, The Good Guys will email you with confirmation of dispatch and an invoice for your Order.
30.6 Installation of the Goods is not included as part of the Delivery Charge. Please click here for more information on installation services.
30.7 If you request multiple delivery dates for an Order, The Good Guys may charge separate Delivery Charges for each delivery.
30.8 Not all delivery options described in this section are available for all Orders or on all Accounts.
Parcel Delivery
30.9 Where requested, The Good Guys will deliver to PO Boxes or Postal Lockers in Australia where possible based on the size of the Goods. Where it is not possible to deliver the Goods to a PO Box or Postal Locker and you have input a PO Box or Postal Locker as the delivery address when placing your Order, The Good Guys will call you to arrange an alternative delivery address.
30.10 On delivery you may be required to sign a proof of delivery document. If you are not available to take delivery we will at our discretion, either:
- take your Goods to our delivery service provider’s local depots;
- ask you if you are willing to give us “authority to leave” the Goods at a place that you believe is safe at, or outside, the delivery address;
- take your Goods to a The Good Guys nominated alternate delivery point that is close to your delivery address (e.g. pharmacy, petrol station, post office or newsagent); or
- re-deliver your Goods to your delivery address at a later date.
30.11 You will receive a text message and/or a calling card at your delivery address containing details of the local depot, alternate delivery point or contact details for you to arrange for re-delivery of your Goods. Please note that if you do not pick up your Goods from the nominated alternate delivery point within the period specified in the text message and/or calling card, your Goods will be taken to one of our delivery service provider’s local depots for you to pick up at your convenience. If you provide “authority to leave”, we will leave the Goods at the agreed place. Risk and title in Goods passes to you at this time and you will bear the risk of any loss or theft of the Goods.
30.12 If you require Goods that you have ordered to be re-directed to an address which is not the original Order address, and such Goods have already been dispatched, The Good Guys will use reasonable endeavours to re-direct the Goods to your requested address and The Good Guys may charge you a reasonable fee for doing this.
On Demand Delivery
30.13 When you request On Demand Delivery you may be required to confirm if you will be at home at the time of the delivery or otherwise provide us with “authority to leave” and we will leave the Goods in the agreed place. Unless you have provided us with such “authority to leave”, on delivery you may be required to sign a proof of delivery document or provide the PIN sent to you in the confirmation SMS or email for your Order, or at the time you place your Order. If you have not provided us with “authority to leave” and you are not available to take delivery, your Goods will be returned to the store and we will contact you to arrange for collection by you or re-delivery. If you provide us with “authority to leave”, delivery will be deemed to have occurred when we leave the Goods in the agreed place (and in accordance with section 30.11, risk and title in Goods passes to you at this time and you will bear the risk of any loss or theft of the Goods from this time onwards).
30.14 If you want to change the delivery date The Good Guys require a minimum of 24 hours’ notice prior to delivery.
Door to Door Delivery
30.15 Door to Door delivery is TGG’s standard delivery service where your Goods will be delivered to your Premises. Door to Door delivery is available to most locations in Australia and Tasmania.
30.16 On the Website, the postcode search bar on the delivery page, product page or in the shopping cart will confirm the cost of Door to Door delivery to your area based on the Goods, your postcode and the delivery zone that it falls in.
30.17 In addition to these Terms and Conditions, if your Goods are being delivered, TGG’s Home Delivery Terms of Sale will apply. For TGG’s Home Delivery Terms of Sale please visit our Home Delivery Terms and Conditions. If there is any inconsistency between these Terms and Conditions and TGG’s Home Delivery Terms of Sale, these Terms and Conditions will prevail to the extent of any inconsistency.
Premium Delivery
30.18 Premium delivery is TGG’s upgraded delivery service. TGG will deliver your Goods, unbox the Goods, remove any packaging, as well as take away any old product.
30.19 Premium delivery is available on all whitegoods, kitchen appliances, laundry appliances, air conditioners, desktop computers and selected small household appliances.
30.20 The postcode search bar on the delivery page, product page or in the shopping cart on the Website will confirm if Premium Delivery can be provided to your area for the particular Goods. The cost of Premium Delivery is based on the Goods, your postcode and the delivery zone that it falls in. Standard charges apply for single storey dwelling. Additional charges may apply for dwellings with stairs.
30.21 In addition to these Terms and Conditions, if your Goods are being delivered, TGG’s Home Delivery Terms of Sale will apply. For TGG’s Home Delivery Terms of Sale please visit our Home Delivery Terms and Conditions. If there is any inconsistency between these Terms and Conditions and TGG’s Home Delivery Terms of Sale, these Terms and Conditions will prevail to the extent of any inconsistency.
Big and Bulky Delivery
30.22 For delivery of big and bulky items, The Good Guys’ Big and Bulky Delivery Terms and Conditions will also apply. If there is any inconsistency between these Terms and Conditions and The Good Guys’ Big and Bulky Delivery Terms and Conditions, these terms will prevail to the extent of any inconsistency.
Vendor or Distributor Delivery
30.23 If the Goods the subject of a delivery are to be delivered to you directly from one of The Good Guys’ distributors, suppliers and/ or vendors (“Direct Delivery”), then the terms and conditions applicable to that Direct Delivery will be the delivery terms and conditions of that relevant distributor, supplier and/ or vendor, as the case may be.
Pre-Orders
30.24 The Good Guys’ arrangements with its suppliers means that The Good Guys is only permitted to dispatch online Pre-Orders no earlier than one day prior to the official release date of the Goods offered for Pre-Order. Goods ordered:
- up to 7 days prior to the official release date are (unless otherwise advised) guaranteed to be despatched from our warehouse no later than one day prior to the official release date, and will be delivered to your designated delivery address within Australia in accordance with your Selected Delivery Option for those Goods. If you have chosen to pick up those Goods in-store (i.e. the Click & Collect option) you can pick up the Goods at your nominated collection store on the release date; or
- within 7 days prior to the official release date may only be despatched on or after the official release date. If you have chosen to pick up those Goods in store, the Goods may only be available to pick up at your nominated collection store after the release date.
31. Click & Collect
31.1 Many Goods can be picked up from a The Good Guys store, or where the Goods are “big and bulky”, from a Distribution Centre, rather than being delivered to you. Where you wish to do this you will need to select this option when you place your Order. Please note that some Goods are not available for pick up from store or a Distribution Centre.
31.2 Only the person named on the relevant Order confirmation may pick-up the Goods in-store or from a Distribution Centre, unless “Friend pick-up” (where you nominate another person to pick-up your Goods) was selected when the Order was placed.
31.3 If you choose to pick up your Order in store, once The Good Guys has confirmed that the Order is available for pick up, you may pick up the Order:
- during the business hours of your nominated collection store; or
- the next business day if your Order is confirmed less than 1 hour before the close of trading hours for the nominated store.
31.4 If you choose to pick up your Goods from a Distribution Centre, your Order should be available for pick up from the Distribution Centre at any time after you place your Order during the Distribution Centre’s opening hours. Collection of your Order may take up to twenty minutes at busy times.
31.5 When picking up Goods in store or at a Distribution Centre:
- you must provide photo identification (current drivers licence, passport or any government issued photo ID card) to store staff to verify that the purchaser. If requested, you must allow The Good Guys to take a copy of this identification for fraud prevention purposes. The copy will not be used by The Good Guys for any other purpose;
- The Good Guys staff may also check your signature against the signature on any credit/debit/payment card used to purchase the Goods. You must therefore ensure that you bring this card when picking up the Goods;
- if you paid using PayPal, you will also need your PayPal Transaction ID;
- you will also need to bring the email that The Good Guys has sent to you confirming that the Goods are available for pick-up; and
- The Good Guys staff have the right to refuse collection of Goods if you cannot or will not satisfy the requirements set out above. In this event The Good Guys will contact the person who placed the Order using the contact details provided.
31.6 In respect of the estimated time for collection, references to “same day” or “next day” on the Website exclude public holidays where The Good Guys does not trade in the State or Territory of your nominated collection store.
31.7 The Good Guys reserves the right to allocate Goods that are not collected within 28 days of the date of your Order to another customer order and to reorder the Goods for you.
31.8 If you fail to collect the Goods within 28 days of the date of your Order, at The Good Guys’ discretion, The Good Guys may agree to hold the Goods for a longer period subject to a daily storage fee.
31.9 When picking up “big and bulky” Goods at a Distribution Centre or in-store:
- you must ensure your vehicle is appropriate for transporting your Goods. The law requires that the Goods are adequately restrained so you should bring appropriate restraints to safely secure your load;
- your Order confirmation must be presented for collection, and you will be asked to sign that you have received your Goods in good condition;
- manufacturers usually recommend that TVs & whitegoods are transported upright to avoid damage. The Good Guys accepts no responsibility for any loss, damage or liability suffered by you due to the way in which the Goods are loaded or transported by you. The Good Guys team members may help to load Goods into your vehicle (but not onto the roof or roof racks) if requested and they believe it is safe to do so, and may provide suggestions to you as to ways to transport your Goods in order to avoid damage. However, you are entirely responsible for ensuring that the Goods are loaded and transported in accordance with relevant road traffic/safety laws and in a way which does not result in damage to the Goods;
- The Good Guys does not provide forklifts when loading and will not assist with roof top loading;
- if you have any concerns about picking-up your Goods, please call your store to arrange delivery.
32. DELAY IN AVAILABILITY OR DELIVERY OF GOODS
32.1 You agree and acknowledge that:
- The Good Guys does not guarantee the dispatch or delivery or availability of Goods within the timeframes, estimated delivery times listed for the Delivery Options or the Selected Delivery Option for your Order, or any other timeframes or otherwise specified by The Good Guys or any of its staff;;
- stock availability and events outside The Good Guys’ control (including adverse weather conditions, traffic conditions and governmental action) may cause delays, or in some circumstances, prevent your Goods from being delivered or available for pick-up in-store or at a Distribution Centre or available for pick-up in store; and
- delays are particularly likely to occur during busy sale periods such as those around Black Friday, Christmas, Easter and public holidays.
33. REFUNDS OF YOUR MONEY
33.1 Where The Good Guys is obliged to refund your payment pursuant to these Terms and Conditions, The Good Guys aims to initiate your refund to your original payment method(s) within 2 business days (Monday – Friday 9 a.m. to 5 p.m. Melbourne time). The additional time that it takes for you to actually receive your refund will depend upon how quickly your financial institution or other payment provider processes the refund. Please note that if The Good Guys is obliged to provide you a partial refund of your payment for specific Goods in your Order, we will only refund the component of the Delivery Charge relating to the Goods which are subject to the refund.
34. RETURNS/FAULTY OR DAMAGED GOODS
34.1 You should check your Goods as soon as they are delivered to you in order to ensure that: (i) they are what you ordered; and (ii) they are not damaged or faulty. If this is not the case you should contact The Good Guys on commercialsupport@thegoodguys.com.au as soon as possible. Where you are not a Consumer, if you fail to give notice to The Good Guys of any problem or defect with the Order within 7 days of delivery, The Good Guys reserves the right (acting reasonably and in good faith) not to accept return of the Goods or any liability for any alleged damage.
34.2 Except to the extent otherwise required by law or where the Goods are faulty (in which case Sections 34.4 - 34.6 apply), all returns of goods that have been correctly delivered to you in accordance with an Order must be approved in writing by The Good Guys (“Approved Returns”). The Good Guys reserves its absolute discretion to accept or reject requests for return of such Goods. Except to the extent otherwise required by law or where the Goods are faulty (in which case Sections 34.4 - 34.6 apply), bespoke, indent or customer Orders will not be accepted for return under any circumstances. Approved Returns must be freight prepaid by you. The Good Guys will credit or refund you for Approved Returns only if they are in saleable condition (as reasonably determined by The Good Guys) upon return and then only upon conditions acceptable to The Good Guys and at your entire cost and provided the goods are and remain sealed in a manner in which they were delivered and accompanied by documentation showing:
- customer name, address and account number;
- invoice number; and
- the reason for return and copy of approval issued by The Good Guys.
Approved Returns are at your risk as to loss or damage until such time as the goods reach The Good Guys’ place of business.
34.3 Our goods usually come with warranties from the manufacturer. Your rights under these warranties are governed by the specific terms of the warranty. The Good Guys has no liability to you in respect of such warranties.
34.4 In respect of goods supplied under these Terms and Conditions, subject to Section 34.5, if you are a Consumer and are purchasing goods which are not of a kind ordinarily acquired for personal, domestic or household use or consumption, the liability of The Good Guys for loss, however caused (including by the negligence of The Good Guys), suffered or incurred by you because of a failure to comply with a Consumer Guarantee is limited to The Good Guys (at its election):
- replacing the goods or supplying equivalent goods;
- repairing the goods;
- paying the cost of replacing the goods or of acquiring equivalent goods; or
- paying the cost of having the goods repaired.
34.5 Section 34.4 does not apply if it is not fair or reasonable for The Good Guys to rely on them, if the goods are Consumer Goods, or in relation to Title Guarantees.
34.6 When you are entitled to return faulty Goods:
- please provide The Good Guys with your proof of purchase;
- it is a requirement for the fulfilment of refunds, exchanges and warranties that you use their best endeavours to return all out-of-the-box accessories (such as power cords and batteries) supplied at the time of original purchase.
You are also encouraged to use the original packaging where possible in order to avoid damage in transit.
34.7 You are not entitled to any refund or exchange just because any packaging is damaged in transit. The packaging exists to protect the Goods themselves.
34.8 If Goods are unused but have been unpacked, we may, at our absolute discretion, accept return of the Goods in the event of a change of mind provided they are in perfect condition. However, in such cases we will not refund any Delivery Charge, and you must pay for us to pick up the goods if you are unable to return the Goods to a The Good Guys store and we will apply a restocking fee equal to 20% of the original purchase price.
35. PRIVACY
35.1 The Good Guys policy on the collection, use and disclosure of customers’ personal information is set out in its Privacy Policy which forms part of these Terms and Conditions.
36. COMMISSIONS PAID FOR SALES AND LEAD GENERATIONS
36.1 From time to time The Good Guys may pay third parties and affiliate partners commissions for referrals leading to sales and/or lead generation. The Good Guys currently pay commissions to a number of third parties and affiliate partners, please see the attached list for their details.
37. AGENCY PRODUCTS
37.1 The Good Guys act as an agent on behalf of the manufacturer/suppliers listed below. Agency products refer to The Good Guys as an “agent” on the product pages. Agency products are shipped directly from the manufacturer/supplier to the customer. When you purchase an agency product you are subject to their terms and conditions of sale below. From time to time, The Good Guys receives commissions acting as an agent on behalf of the manufacturer/supplier, please see attached list for details.
38. WEBSITE TERMS
38.1 Your use of the Website is governed by the Website Terms of Use.
39. GENERAL
39.1 The Good Guys reserves the right to amend these Terms and Conditions at any time. Any amendment will take effect from the time that it appears on the Website. The terms and conditions which apply at the time that you place your Order are the terms and conditions which will apply to your Order.
39.2 Any provision in this agreement which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise shall be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of this agreement or affecting the validity or enforceability of that provision in any other jurisdiction.
39.3 These Terms and Conditions are governed by the laws of Victoria, Australia.
